Print & Design
Introduction
By using our services, the client agrees to be bound by these terms and conditions.
Quotes & Estimates
All quotes and estimates provided by Fortyfour Creative are valid for 30 days from the date of issue.
Quotes are based on the information provided by the client. Any changes to the project scope may result in additional charges.
Orders & Payment
Balance is due upon completion of the project, prior to delivery of the final product.
Payments can be made via bank transfer.
Late payments may incur charges.
Design Process
Fortyfour Creative will provide a specified number of design concepts and revisions as agreed upon in the project proposal.
Additional revisions beyond the agreed-upon number will be charged an extra cost per hour.
The client is responsible for providing clear and accurate feedback during the design process.
Proofing & Approval
The client must review and approve all proofs before printing.
Fortyfour Creative is not responsible for any errors, including but not limited to typographical, colour, or layout errors, after the client has approved the final proof.
Any changes requested after approval will be subject to additional charges.
Production & Delivery
Production times will be outlined in the project proposal. Fortyfour Creative will make every effort to meet these timelines but cannot be held responsible for delays caused by third parties.
Delivery costs will be included in the final invoice unless otherwise stated.
Fortyfour Creative is not responsible for any damage or loss of goods during shipping.
Intellectual Property Rights
All design work remains the property of Fortyfour Creative until full payment has been received.
Upon full payment, the client is granted a non-exclusive license to use the design for the intended purpose.
Fortyfour Creative reserves the right to use any work for promotional purposes unless otherwise agreed in writing.
Cancellations & Refunds
The client may cancel the project at any time by providing written notice to Fortyfour Creative.
The client will be liable for all work completed up to the date of cancellation.
No refunds will be given for completed work or for any deposits paid.
Warranties & Limitation of Liability
Fortyfour Creative warrants that the services provided will be carried out with reasonable care and skill.
Fortyfour Creative is not liable for any indirect, incidental, or consequential damages arising from the use of the designs or printed materials.
The maximum liability of Fortyfour Creative shall not exceed the total amount paid by the client for the services provided.
Confidentiality
Fortyfour Creative agrees to keep all client information confidential and not to disclose it to any third party without the client’s prior consent.
Governing Law
These terms and conditions are governed by the laws of UK.
Any disputes arising from these terms and conditions shall be resolved in the courts of UK.
Amendments
Fortyfour Creative reserves the right to amend these terms and conditions at any time. Any amendments will be communicated to the client in writing.
Force Majeure
Fortyfour Creative shall not be liable for any failure to perform its obligations under these terms and conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, war, or industrial action.
Acceptance
The client agrees to these terms and conditions by requesting Fortyfour Creative for design and printing services.
Print Colour
Introduction
These Terms & Conditions govern the understanding between Fortyfour Creative and the Client regarding colour variations in printed materials. By engaging our design and print services, the Client acknowledges and agrees to these terms.
Colour Accuracy
While Fortyfour Creative strives to achieve the highest level of accuracy in colour reproduction, the Client acknowledges that slight variations between on-screen colours and printed colours may occur. These variations can be due to differences in screen calibration, print materials, inks, and printing processes.
Screen vs. Print Colour
Colours displayed on digital screens (e.g., monitors, smartphones) are generated by light and may appear different from the printed output, which is produced using inks on paper or other substrates. The Client understands that exact colour matching between on-screen designs and printed materials cannot be guaranteed.
Print Process & Materials
The Client acknowledges that factors such as paper stock, finish (e.g., matte, gloss), and the printing method (e.g., digital, offset) can impact the final appearance of printed colours. These factors may cause variations in colour and texture, which are considered normal within industry standards.
Proofing
Fortyfour Creative will provide digital proofs or printed proofs (at an additional cost, if applicable) for the Client’s approval before proceeding with final printing. The Client is responsible for reviewing these proofs carefully and requesting any necessary adjustments. Approval of proofs confirms the Client’s acceptance of the colours and overall design.
Colour Tolerances
Slight colour deviations are common in printing and are within acceptable industry tolerances. These tolerances are typically within a 5-10% range for most print jobs. Fortyfour Creative cannot be held liable for variations within this range.
Reprints & Refunds
If the Client is dissatisfied with the colour output, Fortyfour Creative will review the situation. Reprints or refunds will only be considered if the colour deviation is significantly beyond industry-standard tolerances and is due to a production error on our part. Any reprints or refunds are at the discretion of Fortyfour Creative and must be requested within 7 days of receiving the printed materials.
Third-Party Printers
If the Client opts to use a third-party printer for the final production of materials designed by Fortyfour Creative, we are not responsible for any colour variations or discrepancies in the printed output. The Client should consult with their chosen printer regarding colour management and proofing.
Liability
Fortyfour Creative’s liability for any claim arising from colour variations in printed materials shall be limited to the cost of the design and print services provided. We shall not be liable for any indirect, incidental, or consequential damages.
Amendments
Fortyfour Creative reserves the right to amend these Terms & Conditions at any time. Any changes will be communicated to the Client and will apply to future orders.
Acceptance of Terms
By placing an order with Fortyfour Creative, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions regarding printed colour variations.
Signage
Definitions
“Client” refers to the individual or company purchasing signage products from the Supplier.
“Products” refers to Correx, Foamex, Dibond, and Acrylic signs supplied by the Supplier.
Product Description
Correx : A lightweight corrugated plastic, ideal for temporary signage.
Foamex : A PVC foam board, used for semi-permanent signage and displays.
Dibond : An aluminium composite material, known for its durability and suitability for outdoor and long-term use.
Acrylic : A clear or coloured plastic material, often used for high-end signage due to its glossy finish.
Material Choice
The Client is responsible for selecting the appropriate material based on their specific needs. Fortyfour Creative may provide recommendations but is not liable for the suitability of the material for the Client’s intended purpose.
The Client acknowledges that each material has different properties, including durability, flexibility, and resistance to weather conditions.
Colour & Printing
Fortyfour Creative endeavours to match the colours as closely as possible to the Client’s specifications. However, slight variations in colour may occur due to material differences and printing processes.
The Client accepts that colours viewed on digital screens may not perfectly match the printed products.
Weather Damage & Durability
Expected durability of each material under typical conditions:
Correx : Suitable for temporary outdoor use; may degrade over time when exposed to prolonged weather conditions, particularly UV light.
Foamex : Suitable for indoor or short-term outdoor use; susceptible to warping or fading when exposed to weather conditions.
Dibond : Highly durable and resistant to weather damage, suitable for long-term outdoor use.
Acrylic : Suitable for indoor or outdoor use; durable but can crack or fade if exposed to weather conditions.
Fortyfour Creative is not liable for damage caused by weather, vandalism, or misuse after the products have been delivered and accepted by the Customer.
Delivery & Inspection
The Client must inspect all products upon delivery and report any defects or issues within 48 hours.
Fortyfour Creative is not liable for any defects reported after this inspection period.
Warranty & Liability
This warranty does not cover:
• Normal wear and tear.
• Damage caused by improper installation, exposure to weather, or vandalism.
• Colour fading over time, especially in outdoor environments.
Fortyfour Creative liability is limited to the repair or replacement of defective products.
Installation
The Client is responsible for the correct installation of the products.
If installation services are provided by Fortyfour Creative, a separate agreement will govern the terms of installation.
Acceptance of Terms
By placing an order with Fortyfour Creative, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions regarding Signage.
